Welcome to Nordhorn Tracker (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at https://nordhorn.bordertanker.nl/ (the “Service”). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By logging in or browsing any portion of the Site, you agree to comply with all terms and conditions stated herein. If you do not agree to these Terms, you must not access or use the Service.

2. Changes to Terms

We may modify these Terms at any time in our sole discretion. Whenever changes are made, we will update the “Last updated” date at the top of this page. Your continued use of the Service after such updates constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

3. Description of Service

Nordhorn Tracker is a companion web application to display real-time swimming programs and series for the Nordhorn 2025 event. Key features include:

• Viewing the current swim programs and series running in the pool.
• Switching between “Programs” view and “Notes” view for your convenience.
• Ability to write, edit, and save personal notes—stored locally on your device (see Section 7).
• Access to a protected area requiring valid credentials (managed by site administrators), ensuring that only authorized personnel can view real-time status data.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

4. User Accounts and Access

Public registration is not provided. All user accounts (login credentials) are created and managed by site administrators. If you have been given credentials, then:

• You are responsible for safeguarding that information. Do not share your login details with others.
• You agree not to allow any unauthorized party to access the Service under your account.
• You must notify us immediately if you suspect any unauthorized use.

We may deactivate or delete any account if we believe it was issued in error or is being abused.

5. User Conduct

When using the Service, you agree that you will not:

• Use the Site for any unlawful purpose or in violation of any local, national, or international law.
• Upload or transmit any viruses, malware, or harmful code to our servers.
• Impersonate any person or misrepresent your affiliation with any entity.
• Attempt to gain unauthorized access to any portion of the Service, including bypassing authentication.
• Collect or harvest any information from other users.

6. Intellectual Property

All content available on the Site—such as text, graphics, logos, images, audio clips, and software (collectively, “Content”)—is owned by Nordhorn Tracker or its licensors and is protected by Dutch and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Content without our express written permission.

7. Notes Stored Locally

Any personal notes you create under the “Notes” view are saved only in your browser’s localStorage; they are never transmitted to or stored on our servers or in any database. As a result:

• You are solely responsible for backing up or exporting your notes if you need a permanent copy.
• Clearing your browser cache/cookies or using a different browser/device will result in loss of those notes from that specific environment.
• We have no access to your localStorage; we cannot recover lost or deleted notes.

8. Privacy

Your privacy is very important to us. Please review our Privacy Policy to understand what information (if any) we collect, and how we use and protect it. By using the Site, you acknowledge that you have read and accepted our Privacy Policy.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without prior notice, for any reason, including violation of these Terms. Upon termination, you lose access to any protected pages and real-time data feeds. Your localStorage data (notes) remains on your device but may become irretrievable if you no longer have access to the Service’s interface.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORDFORN SERIES TRACKER AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES;
• ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL;
• ANY CLAIMS BY THIRD PARTIES; OR
• ANY OTHER DAMAGES ARISING OUT OF OR RELATING IN ANY WAY TO YOUR USE OF THE SERVICE OR YOUR INABILITY TO ACCESS YOUR LOCAL NOTES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED €100 OR THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS, WHICHEVER IS GREATER.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to any conflict-of-law provisions. Any dispute arising out of or relating to these Terms shall be brought exclusively in the courts located in Arnhem, Netherlands.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions will remain in full force and effect.
